Action in the district court for Meeker county for personal injuries and for property damage arising out of a collision between plaintiffs auto, driven by Vernon Watkins, and an auto owned by defendant Minar Motor Company and driven by defendant Reuben Carlson in which action defendant Minar Motor Company counter-claimed for damages to its auto. The case was tried before Harold Baker, Judge, and a jury, which returned a verdict for plaintiff for $10,000. Plaintiff appealed from an order denying his alternative motion for a new trial on the issue of damages or for a new trial on all issues. Reversed and new trial granted on all issues.
